Terms of Service

1. Who operates the service
tcomGames is the games brand of tognella.com, operated by Patrick Tognella, Bündtenweg 22, 5064 Wittnau, Switzerland. These terms cover the tcomGames portal, StackDare and other games that expressly link to these terms. Contact: games@tognella.com. Further details are in our legal notice.
2. Using our games
Our current games are free to play. You may play as a guest without creating an account. By choosing to use the service, you agree to these terms. If you are not legally able to agree on your own, you need permission from a parent or legal guardian. Any third-party sign-in provider’s eligibility requirements also apply.
We grant you a personal, non-exclusive permission to access and play the games for their intended purpose. This does not transfer ownership of the games, artwork, software or branding. Rights granted by applicable open-source licences or mandatory law remain unaffected.
3. Optional accounts
Where enabled, you can create or access a tcomGames account using Google sign-in. Use only an account you are authorised to use. Keep access to your Google account and your devices secure, and tell us if you suspect someone has accessed your tcomGames account without permission. We do not receive your Google password.
Signing in with the same Google account lets you access the same player profile across supported devices and game domains. Games use central tcomGames sign-in; you confirm the destination game before a local session is established. When you agree to transfer guest progress, we keep the better eligible score per leaderboard. Existing account details take precedence over guest details. Guest progress may become inaccessible if you clear browser data or change devices without linking an account.
4. Fair play and player names
Do not manipulate scores, submit fabricated results, use bots to gain an unfair leaderboard advantage, exploit vulnerabilities to disrupt the service, evade account restrictions, or access another person’s account or non-public data without permission. Report suspected security issues to games@tognella.com without exploiting them further.
Choose a player name that does not impersonate others, reveal someone else’s private information, infringe rights, or contain unlawful, hateful or harassing content. You allow us to display your chosen player name, optional country and eligible results in the game and its leaderboards. We do not claim ownership of your player name.
5. Results and leaderboards
Ranked results are subject to server validation. Offline practice may not qualify for rankings. We may correct or remove results affected by cheating, errors or technical faults. Game rules, scoring and leaderboard periods may change; material changes will be explained in the game or portal. Scores have no monetary value and cannot be exchanged for money. No prize is promised unless separate, explicit competition rules say otherwise.
6. Availability and changes
The service is under active development. Maintenance, faults or changes may interrupt access or affect progress. We do not promise uninterrupted availability or permanent storage of every result. We will give reasonable notice of planned material reductions or discontinuation where practicable, except where urgent security or legal reasons require immediate action.
The current version has no paid subscriptions or in-game purchases. If paid features are introduced, their price and applicable conditions will be shown before purchase. These terms do not authorise automatic charges. Advertising and related data processing, if introduced, will be described before activation and consent requested where required.
7. Restrictions and ending use
We may restrict an account or remove a result where reasonably necessary to address a breach of these terms, suspected abuse, a security risk or a legal obligation. We aim to act proportionately and provide a reason where lawful and practicable. You can request a review at games@tognella.com. Guest play may remain available even when an account is suspended.
You can stop using the service at any time and sign out of all account sessions from the account page. For account deletion, contact games@tognella.com; we may need to verify ownership. Signing out alone does not delete your account or results. Requests are handled subject to applicable legal obligations.
8. Privacy and third-party services
Our Privacy Policy explains the data used for profiles, authentication and results. Google’s terms and privacy information govern your use of Google sign-in. These terms do not grant permission to use your data beyond the purposes described in our privacy information.
9. Responsibility
We are responsible in accordance with applicable law. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for intentional misconduct or gross negligence where applicable. Mandatory consumer protections remain unaffected.
10. Updates and applicable law
We may update these terms to reflect changes to the service or legal requirements. We will publish the updated version and its date and notify account users of material changes through the service before they take effect where practicable. Where agreement is required, we will ask for it. Changes do not retroactively remove accrued rights.
Swiss law applies, subject to any mandatory protections applicable to you in your country of residence. Any mandatory rules on jurisdiction remain unaffected. Please contact games@tognella.com first if you have a concern so we can try to resolve it.
